1. GENERAL PROVISIONS
Maggini Select S.r.l. is a limited liability company established and registered in Italy, with registered office in Via Francesco Serritelli 31, 00123 – Rome (hereinafter the "Company").
The Company operates the Fuix e-commerce website and retails numerous products including footwear, backpacks, bags, sportswear and other items (the "Products") from leading national and international brands directly to customers via www.fuix.com (the "Site").
Maggini Group S.r.l. is the parent company of Maggini Select S.r.l. and may be involved, where necessary, in administrative, organisational or support activities. The sale of Products on the Site is carried out exclusively by Maggini Select S.r.l.
The sale of Products on the Site is subject to the following Terms and Conditions of Sale (the "Terms of Sale").
These Terms of Sale apply whenever the Customer makes a purchase on the Site.
2. CONSUMER INFORMATION
2.1. Products available on the Site are offered for sale both to consumer Customers and to Professionals, as defined by applicable law.
A consumer Customer means any natural person making purchases for purposes unrelated to any commercial, business, artisanal or professional activity. Purchases on the Site are permitted only to persons over 18 years of age who hold a valid credit or debit card accepted by the Company and are authorised to use it. Certain Products offered on the Site may not be suitable for persons under 18 years of age.
2.2. Before submitting a purchase order, the Customer must carefully read these Terms of Sale, which shall be deemed accepted upon completion of the purchase procedure. Together with the Privacy Policy, these Terms of Sale govern the contract between the Customer and Maggini Select S.r.l.
2.3. By submitting the purchase order, the Customer accepts and undertakes to comply with these Terms of Sale. If the Customer does not accept any of the provisions set out herein, the Customer must not place any order for Products on the Site.
2.4. These Terms of Sale are important because they set out the respective rights and obligations of the Company and the Customers and provide useful information.
These Terms of Sale may be updated from time to time; Customers are therefore requested to review them before each purchase, as the latest version will always apply.
3. ORDER PROCEDURE AND ACCEPTANCE
3.1. To purchase one or more Products, the Customer must select the Products of interest, choose the colour and indicate the required size. Selected Products will be added to the Cart. To save Products in the Cart for a later purchase, the Customer must create an online account (User Profile). Purchases without registration are possible; however, all Products in the Cart will be deleted if the process is not completed.
3.2. The Customer may modify any information entered during the purchase process up to the moment of confirming the order. Once the order has been submitted, it can no longer be modified or cancelled.
3.3. The sale procedure shall be deemed completed only when the Customer submits the purchase order by clicking the "Buy" button. The Customer must provide personal data including name, address, e-mail and payment details, and confirm acceptance of these Terms of Sale.
3.4. After submission of the order, the Company will send the Customer an Order Confirmation e-mail. Customers with a User Profile may access their orders at any time on the Site or by contacting Customer Service.
3.5. The Company reserves the right not to accept orders that do not meet the requirements, where a legal dispute relating to a previous order exists, or for any other legitimate reason. The Company also reserves the right not to accept orders that appear to have been placed by resellers or distributors.
3.6. For each Product offered for sale, an image of the Product will be displayed together with the unit price, available colours and sizes. Product images are provided for illustrative purposes only and may not fully correspond to the actual Products due to technical reasons not attributable to the Company.
3.7. The Company informs the Customer that certain information on the Site, including Product descriptions, translations and editorial content, may be generated or assisted by artificial intelligence systems. Such content is subject to internal review but may, in limited cases, contain inaccuracies. Customers are invited to always refer to the Product actually received and to contact Customer Service if in doubt. Applicable provisions on product conformity, right of withdrawal and legal warranty remain fully in force.
4. PRODUCT AVAILABILITY
4.1. The Company undertakes to ensure the availability of all Products offered on the Site. However, in exceptional cases, Products offered for sale may not actually be available.
4.2. If the Products ordered are temporarily unavailable, the Company will inform the Customer by e-mail. If the Products are definitively unavailable, the Customer's payment will not be charged. If payment has already been charged, a refund will be issued within 14 working days to the payment method used for the order.
5. PRICE AND PAYMENT
5.1. Prices of Products offered for sale on the Site are expressed in EUR (€).
5.2. All Product prices shown on the Site are inclusive of VAT. Unless otherwise indicated during the purchase process, prices also include standard shipping and delivery costs. Any additional costs, where applicable based on order value, selected shipping method, delivery address, destination country, or customs duties and taxes imposed by the customs authorities of the destination country, will be shown to the Customer before order confirmation.
5.3. The Company also accepts payments via PayPal and related payment circuits.
5.4. For payments via MasterCard, Visa and PayPal, Products will be shipped only after the Customer's payment details have been verified and payment authorisation has been received from the Customer's bank.
5.5. All Products are supplied with an identification tag that forms an integral part of the Product.
6. SHIPPING AND DELIVERY
6.1. Products will be shipped to the address provided during the purchase process. For security reasons, the Company does not ship to PO Boxes.
6.2. For order preparation, shipping and delivery operations, the Company may use third-party logistics partners, including specialist operators.
6.3. Order preparation and handling may take up to 3 business days from the Order Confirmation or receipt of payment authorisation. After shipment, estimated delivery is generally within 2–5 business days, depending on the delivery address, destination country, carrier and logistical availability.
6.4. If the Customer does not receive the Products within the estimated timeframe or wishes to obtain delivery status information, the Customer may contact the Company using the details provided in the Customer Service section.
7. RIGHT OF WITHDRAWAL
7.1. Customers have the right to withdraw from the purchase contract, without penalty and without giving any reason, within 30 days from the date of receipt of the Products purchased on the Site.
7.2. To exercise the right of withdrawal, the Customer must inform the Company in writing of the intention to withdraw from the contract.
7.3. Refunds will be issued provided that the Products have not been used and are in the same condition in which they were delivered.
7.4. The Company reserves the right to inspect returned Products and refuse the return of Products that do not meet the conditions indicated.
7.5. Unless the Product received is incorrect, defective, damaged or non-conforming, return shipping costs are the Customer's responsibility. The Customer is responsible for the correct shipment of the return until delivery to the Company or the designated return recipient.
7.6. Once the returned Products have been received and their compliance with the stated conditions has been verified, a refund of the price of the returned Products will be issued to the payment card or bank account used for the purchase, as soon as possible and in any event within 14 days of confirmation of receipt of the returned Products, subject to any delays not attributable to the Company.
7.7. If the returned Products were purchased as a gift, the refund will be issued to the person who made the payment.
7.8. To return Products to the Company, Customers must follow the instructions provided inside the Product packaging or on the Site.
7.9. If the Product received is incorrect, defective, damaged or non-conforming, the Customer is invited to contact Customer Service before proceeding with the return. In such cases, the Company will handle the request in accordance with applicable law and, where applicable, will bear the return shipping costs.
8. CHANGES AND CORRECTIONS TO THE TERMS OF SALE
8.1. The Company reserves the right to amend or correct these Terms of Sale, the Privacy Policy, the withdrawal information, the Products offered for sale and the prices, at any time and without prior notice to the Customer.
8.2. The Company will use its best efforts to ensure that prices and other Product information displayed on the Site are accurate and up to date.
8.3. If the Customer's payment method has been charged for a cancelled order, the Customer will be informed and refunded within 14 days.
8.4. All amendments and/or corrections indicated above shall apply exclusively to purchase orders submitted after the date of the amendment or correction made by Maggini Select S.r.l.
9. LEGAL WARRANTY FOR NON-CONFORMING PRODUCTS
9.1. Products offered for sale are covered by a legal warranty of 24 months from the date on which the Customer receives them.
9.2. Customers must inform the Company of any defect or non-conformity of Products purchased within the legal warranty period by writing to Customer Service.
9.3. If the Product received is defective, incorrect, damaged or non-conforming, the Customer must contact Customer Service before proceeding with the return, in order to receive the correct instructions. In such cases, the Company will handle the request in accordance with applicable law and, where applicable, will bear the return shipping costs.
9.4. If the Customer chooses to use return methods other than those indicated by the Company, the Company shall not be liable for any loss of the Product during shipment.

9.5. Maggini Select S.r.l. reserves the right to inspect returned Products in order to verify the existence of the defect or non-conformity.
10. LIABILITY OF MAGGINI SELECT S.R.L.
10.1. Products offered for sale on the Site are provided subject to availability. Without prejudice to the legal warranty referred to in section 9 above, the Company gives no additional contractual warranties beyond those required by law.
10.2. To the maximum extent permitted by applicable law, the Company shall not be liable for any damages of any nature, including without limitation direct, indirect, incidental or consequential damages.
11. APPLICABLE LAW AND JURISDICTION
11.1. These Terms of Sale shall be governed in all respects by Italian law. Any dispute relating to the interpretation, execution and application of these Terms of Sale shall fall within the jurisdiction of the court of the Customer's place of residence where provided by applicable consumer law.
11.2. If any provision of these Terms of Sale is held invalid, void or unenforceable for any reason, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
